The USA is the best model of a presidential form of government, where entire power lies in the hands of the president. He is a constitutional head as well as a real or administrative head of the government. The US president is responsible toward the people, and Congress doesn’t have any authority to pass a no-confidence motion against the president. He can be removed only after 4 years by the people through elections.
Separation of power is a key feature of presidential government of the USA, which work at the following stages—
- Separation at a functional level where Congress is responsible for law-making. The executive is accountable for policy making and implementation of law. However judiciary work for setting the dispute or resolving the dispute
- Separation of power also works as per as the tenure of the organ of the government is concerned.
- Separation at the level of function because a member of the executive cannot become a member of Congress.
Apart from the separation of power, the American Constitution also believes in the principle of checks and balances. The president can check the power of Congress through a veto. Congress is entitled to pass an impeachment motion against the president. The president can sign over any international treaty, but it must be approved by the Senate. The purpose of separation of power is to uphold liberty and constitutionalism. Americans were more willing to make the Republican government. Then a democratic government and principle of checks and balances surpass any possibility of emergency of majoritarianism.
